Common Area Usage Rule (Adopted August 18, 2005)
Pursuant to the Covenants, the Board approved the following
amended Rules and Regulations governing Common Area usage on August 18, 2005.
Residents are responsible for their guests and employees
while on the premises.
- No projectiles shall be allowed
in the common area, including but not limited to: toy guns, BB guns, sling shots of any
kind, bow and arrow or similar equipment;
- No balls or sports equipment may
be used in a manner that may damage personal property, landscaping, or structures,
including but not limited to: baseball
bat, baseball, softball, football, soccer ball, lacrosse or field hockey equipment,
basketball, inline skates, and skateboards;
- No striking, pulling, tearing
or climbing on trees or other landscaping;
- Bicycles, “toy vehicles”1
and all other similar vehicles must stay on common area path or sidewalk.
Usage may not damage path or sidewalk. Bicycles and toy vehicles
must be ridden in a responsible manner at all times. Riders are required to
provide an audible signal to pedestrians before attempting to pass them on
a sidewalk or path. Pedestrians have the right-of-way at all
times.
- Pursuant to Colorado Law, pets
must be on leash at all times and excrement removed immediately;
- No climbing of any fences or building
structures other than those of your personal residence;
- No running in the landscape rock
between houses;
- No excessive noise, including
but not limited to: persistent shouting,
loud music, dog barking, or other noise that may be considered a Nuisance;
- No person shall enter into a window
well or fenced patio area unless specifically authorized by the Owner of that
unit;
- Owners shall be liable for any
and all damage to any building, structure, landscaping or personal property
by any resident, guest or employee of their home;
- After 1st
(first) violation by a minor, children of that household 12 and under must
be supervised at all times by a physically present adult 18 years or older
while in the common area.
1 Effective July 1, 2005, the State of Colorado
adopted the following definition for motorized/electric toy vehicles:
(103.5) "TOY VEHICLE" MEANS ANY
VEHICLE, WHETHER OR NOT HOME-BUILT BY
THE USER, THAT HAS WHEELS WITH AN OUTSIDE DIAMETER OF NOT MORE
THAN FOURTEEN INCHES AND IS NOT DESIGNED, APPROVED, OR INTENDED
FOR USE ON PUBLIC ROADWAYS OR HIGHWAYS. "TOY VEHICLE" INCLUDES, BUT IS NOT
LIMITED TO, GAS-POWERED OR
ELECTRIC-POWERED VEHICLES COMMONLY KNOWN AS MINI BIKES, "POCKET" BIKES, KAMIKAZE
BOARDS, GO-PEDS, AND STAND-UP SCOOTERS.
According to the Colorado Springs Police Department, Toy Vehicles are
not allowed on city streets. Violations should be reported
to the CS Police Department non-emergency number at 444-7000.
